Family Dispute Resolution Procedures (Childrens Matters)
An intake session is undertaken
with the inviting party by appointment. The cost of the initial intake session is $110.00.
Then within 24 hours of the intake
session (usually same day) a written invitation is issued to the other party.
Seven days later a second letter
issues requesting a response (if none has been received). A telephone call may be made a few days
after the first letter if the matter is urgent.
If no response within the 14 days
then a Section 60I certificate may issue and you may need to engage another family lawyer to bring an
application to court.
If there is a response an intake
session is arranged with the invited person.
Mediation agreements will be sent
to the parties with a request for payment of mediation fees.
Following receipt of mediation
agreements and payment mediation dates will be arranged by our office. The venue can be at our
Springwood office, mediation rooms at the Queensland Law Society in Brisbane or some other mutually
agreed venue. Our rooms and those of the QLS are free but the parties will be responsible for
hire charges of other venues equally or as otherwise agreed.
If necessary a Section 60I
certificate will issue promptly in appropriate circumstances.
The Mediation fee schedule is as follows:
Initiating party intake session is
$110. This session is needed to establish whether it is appropriate to send an invitation to the
other party. If both parties approach the mediator then that initial intake session will be at
the same cost for both parties.
To Issue an Invitation (children's
issues) - $220.
Pre-mediation Intake Sessions with both parties prior to mediation (can be by telephone or
personally) $165.00 for each party.
Mediation costs are $165.00 per
hour per party inclusive of GST. Four hours of mediation time is payable in advance with
extra time being paid at the conclusion of the mediation. If the parties or their lawyers request
a full day then 8 hours of mediation fees will be payable in advance.
Issue Section 60I Certificate $110
payable by each requesting party.
